359 Mary St – Nonconforming Footprint Verification -- Current owner requests verification of lawful nonconforming conditions for the existing residential structure/foundation at 359 Mary St SW, Parcel 14 00870003061. The R-4B property is approximately 25' x 100'. The existing structure/foundation encroaches within current setback areas. City records for prior permit BB-202207297 document review of a renovation of the existing residence with a second-story addition utilizing the existing structure/footprint. Please determine: (1) whether the existing foundation/building footprint may be retained and rehabilitated in its present location notwithstanding existing setback nonconformities; (2) whether a second-story addition may be constructed above the existing footprint without increasing the existing horizontal encroachment; (3) whether removal/demolition of the existing foundation or structure would terminate or otherwise affect any lawful nonconforming setback/footprint rights; and (4) what zoning approval, variance or other process, if any, would be required to renovate and vertically expand the existing structure.
