301329 Brooks Non Conforming Request for existing telecom tower within 200' of residential zoned American Tower is requesting to build a new access road which will eliminate some drainage issues that existing at the current telecom site. This was an established telecom site before the residential houses were built. The estimated installation time was end of 1997/early 1998 per the provided BP. I have included some information from the County Appraisal District that shows the property easement for the residential homes adjacent to the tower was created in 2016. The residential houses were assigned deeds after 2017. The land was originally leased but is now owned by American Tower. Deed is included. The current land survey does show the residential properties as it was done in 2025. Currently, American tower does not own any utilities on site. There is an active carrier on the tower who manages their own power. The tower was built to house additional carriers if the opportunity presents itself. While we cannot provide utility bills, the site has been active since its installation. We understand that the code states we need to be 200’ from any residential zoned property however since the tower was built before the residents, we are asking for a non-confirming use approval to allow us to continue to maintain this site. The road improvements will allow better access, decrease flooding issues, and continue to provide a vital service to the local community.
